State Supreme Court Asked to Let Poor Have Tax-Funded Lawyers

MADISON, Wis. (WTAQ) - The Wisconsin Supreme Court will be asked Thursday to let poor people in civil cases have tax-funded lawyers – just like they do in criminal cases.

Legal Action of Wisconsin will submit petitions with 1,300 signatures asking the court to allow public attorneys in the most serious cases that affect a litigant’s basic human needs, including child custody.

It would not provide free legal help to file personal injury lawsuits, or cases like privacy matters that don’t involve basic human needs.

John Ebbott of the Legal Action group says some lawyers and social service groups have talked for years about letting poor litigants get free lawyers in serious civil cases. He says too many people go to court on their own, and, “It’s like trying to do surgery on themselves.”

He says almost 275 lawyers have signed the group’s petition – along with 7 judges and 2 court commissioners. But it wouldn’t be cheap. Ebbott says it would cost $50 to $80 million a year – and some of it could be funded by the surcharge for filing civil cases.
